Stewards gave consideration to a protest which was lodged by trainer D Elder (GRUMPY SHANNON) fourth past the post against CHLOBRO (A Garaty) which was first past the post alleging interference entering the first turn. Upon review of the evidence and the patrol footage Stewards determined that as the field entered the first turn CHLOBRO driven by A Garaty closed down the track and engaged in a jostle with GRUMPY SHANNON (B Elder) when GRUMPY SHANNON had established a position in the running line. The pressure continued for some distance approaching the first turn to which CHLOBRO gained a slight advantage and raced inside the line of GRUMPY SHANNON and as a result was checked and broke stride. At this point Stewards determined that GRUMPY SHANNON was denied its opportunity to remain racing in a running line position and progress forward to which CHLOBRO ultimately was able to gain an uncontested lead with JUSTAWARRIOR surrendering that position. Given the distance lost and the overall finishing efforts of both runners Stewards were of the opinion that if the if the interference had not occurred GRUMPY SHANNON would have finished in advance of CHLOBRO and as a result the protest was upheld with new numbers to read 4, 6, 2 and 5. At a subsequent inquiry A Garaty pleaded guilty to a charge under rule 163(1)(a)(iii) in that when closing down the track entering the first turn engaged in a jostle with GRUMPY SHANNON shortly thereafter gained an advantage whereas a result GRUMPY SHANNON was checked and broke stride. ROCKNROLL CLARRY (J Osborn) which was progressing along the marker pegs was also placed in restricted room and contacted marker pegs. Driver A Garaty’s licence to drive in races was suspended for a period of 28 days. When considering penalty Stewards took into account his guilty plea, driving record and in the opinion of the Stewards the high degree of carelessness.
