In assessing penalty Stewards considered the HRNSW Penalty Guidelines, placing particular weight on Mr McRae’s guilty plea the degree of interference & carelessness which was assessed low & the racing manners of GLAMOUR FOX combined with his overall offence record with his last offence in December 2023 (807) drives. TINNYSMEDAD – ($151.00) Trainer/Driver Ray White pleaded guilty to a charge under AHR Rule 149(2) which reads; A person shall not drive in a manner which in the opinion of the Stewards is unacceptable. The particulars of the charge being that after working forward from the start and obtaining a favourable position three (3) back along the marker line following favourable runners it was unacceptable that Mr White directed TINNYSMEDAD outwards and improved forward to race outside the leader from the 1700m which was beyond the capabilities of TINNYSMEDAD in its current form. It was further unacceptable that passing the 1200m Mr White urged TINNYSMEDAD forward and raced on level terms and unsuccessfully challenge the leader ELLENS DELIGHT (Blake Jones) for the lead until passing the 900m which was beyond the capabilities of TINNYSMEDAD & the main factor in TINNYSMEDAD being placed under pressure passing the 700m and yielding ground rapidly from the 600m to finish in 6th position beaten 67.3m. In determining penalty Stewards were mindful of the relevant considerations as outlined within the HRNSW Penalty Guidelines, Mr White’s guilty plea the degree of culpability which was assessed in the mid-range & his prior record under this rule with his last offence in December 2022 (123) drives.
