General – At the first attempt to start the race a false start was declared when TROUBLE IN HEAVEN broke gait, the Starter reported that he felt THATS THE ATTITUDE had shifted out and caused TROUBLE IN HEAVEN to break gait, so a warning was initially issued to THATS THE ATTITUDE. At the second attempt to start the race TROUBLE IN HEAVEN broke gait, and a false start was declared with a warning being placed on that runner. Following the race when reviewing the patrol footage, it was apparent that at the first attempt to start the race that while THATS THE ATTITUDE had raced ungenerously and shifted-out, TROUBLE IN HEAVEN broke gait free of any interference from that runner and given the circumstances connections were advised that it would be placed outside the draw for future mobile start races.

Raced three wide without cover for the majority of the race before tiring over the concluding stages of the event and was beaten by a considerable margin. Driver E Lepper, with senior Driver J Painting present with him in the inquiry, was questioned regarding the tactics adopted with the gelding, in particular after it galloped leaving the 1400 metres him continuing forward resulting in it racing three wide without cover for a considerable distance before commencing to tire leaving the 600 metres. E Lepper stated that prior to the race the intended tactics were to try and have the gelding travelling comfortably, as it can get fired up, but also to go forward if possible as they felt if it performed to its ability, it was a competitive chance in tonight’s field. He added that after it broke gait after the start he allowed it to continue forward but it began to over-race and contacted its own sulky wheel with its hind leg and broke gait as a result leaving the 1400 metres. He further added that he felt when it got back down pacing, he felt he should try to get the gelding travelling comfortably and didn’t want to fight it to get a position with cover at the rear of the field as he felt it would resent that. E Lepper added that he also felt that if he allowed it to stride forward, they may have been able to get to the position outside the leader leaving the 1000 metres but was unable to do so with TROUBLE IN ME maintaining that position. E Lepper further added that the three wide run resulted in the gelding being unable to be able to finish the race off. Driver E Lepper was reprimanded under Rule 149(2) for driving in the opinion of the Stewards in an unacceptable manner. In assessing the matter, Stewards were mindful of his driving inexperience, in that this is his first season driving in races, he has had just 16 career drives and no previous offences under this rule. A post-race Veterinary examination did not reveal any abnormalities. Connections were advised the gelding would be required to perform a re-qualifying trial.
