Prior to the declaration of all clear, Stewards gave consideration to a protest lodged by Trainer M Callaghan (THE CID) 3rd past the post, alleging ULTIMATE CRUZA (R Morris) 2nd past the post alleging that runner had gained an advantage in the early stages of the home straight by racing inside the line of marker pegs. Upon review, and in assessing evidence from all parties, Stewards determined that prior to entering the home straight WALTER WARLOCK shifted away from the marker pegs marginally and in turn Driver R Morris directed his runner down the track however in the Stewards opinion failed to do so with sufficient room at that point and did race inside the line of one marker peg and in that time despite the best efforts from it driver R Morris by way of restraint, continued to race through and in the opinion of Stewards had gained an advantage. As such given the proximity of both runners at that point of the race and the finishing efforts inclusive of the margin, Stewards upheld the protest and amended the placings accordingly. In not taking more severe action in terms of alteration of the places, Stewards were mindful that SPUNKYS GOTSECRETS had raced clear in the early stages of the home straight and the finishing margins, Stewards did not feel a further alteration was necessary and all clear was given on the amended numbers.
COLOSSAL HOPE – Tightened for racing room inside the 100 metres and was hampered.
ULTIMATE CRUZA – Pre-race blood sample. at a subsequent hearing form the protest, Driver R Morris was fined $100 under Rule 163(1)(c) in that prior to straightening for the finish, directed his runner down the track without sufficient room and as a result contacted marker pegs. In not taking more severe action Stewards were mindful of the movement of WALTER WARLOCK in advance and that driver R Morris took immediate action when racing inside the line of a marker peg.
